⚠ The terms you most need to know
Section 128 of the Federal Competition and Consumer Protection Act 2018 requires that terms which limit risk or impose unusual obligations are drawn to your attention rather than buried. These are ours, in plain English. They do not replace the full terms below — but if you read nothing else, read this.
- We are not a bank or a mortgage lender. We cannot lend you money, approve a mortgage, or issue an approval in principle. Lending in Nigeria is licensed by the Central Bank of Nigeria. See clause 3.2.
- Listings are published by users, not verified by us. Unless you have paid for a verification or inspection service, we have not checked that a property exists, that the person listing it owns it, or that the price or description is accurate. See clauses 5 and 15.
- Being in our agent directory is not an endorsement. Agents register themselves. Unless an agent shows a verification badge, we have checked nothing about them. See clause 6.
- We are not your estate agent, lawyer, valuer or tax adviser unless you have specifically engaged us for a service that says so, and even then only within the scope described. See clause 3.
- We do not hold client money. Never send funds intended for a property purchase to us. See clause 8.5.
- We sometimes have a financial interest in the outcome of advice we give you — for example where we may buy your property, or earn commission on a sale. We disclose this. See clause 9.
- Our liability is capped at the greater of the fees you paid us in the previous 12 months or ₦500,000 — except where the law does not allow us to cap it, which includes death, personal injury, fraud and misrepresentation. See clause 16.
- Nigerian law and the courts of Lagos apply. This does not remove any right you have under Nigerian consumer law. See clause 21.
Nothing in these terms excludes or limits any right you have under the Federal Competition and Consumer Protection Act 2018 or any other law that cannot be excluded by agreement. Section 141 of that Act prevents anyone evading your consumer rights through a secondary contract, and we do not attempt to.
1. Who we are
1.1 Apartments.ng ("the platform", "we", "us", "our") is operated by Apartments Global Limited, a company incorporated on 15 August 2019 under the Companies Act 1963 (Act 179) with registration number CS172462019 and tax identification number C0029163927, whose registered office is at 2nd Floor, 10 Abafun Crescent, Labone, Accra.
1.2 These terms govern your use of apartments.ng and any service you obtain through it. By using the platform, creating an account, listing a property or engaging any of our services, you agree to them. If you do not agree, do not use the platform.
1.3 These terms apply alongside our Privacy Policy, which explains how we handle personal data.
1.4 We operate a related platform in Ghana at apartments.com.gh. These terms apply only to apartments.ng. The Ghanaian platform has its own terms and is subject to Ghanaian law.
2. Definitions
3. What we are — and what we are not
3.1 We operate a property listings platform and provide the paid services described at clause 7. Beyond that, we hold no licence or professional authorisation, and the following limits are absolute.
3.2 We are not a lender
Not a bank, not a mortgage lender, not a Primary Mortgage Bank
We do not lend money. We cannot make a lending decision, approve a loan, issue an approval in principle, or issue a mortgage offer. Banking and mortgage lending in Nigeria are licensed and supervised by the Central Bank of Nigeria under the Banks and Other Financial Institutions Act.
Where we assist with financing, we do so only by explaining options, helping prepare an application, and introducing you to licensed institutions. Any loan is a contract between you and a licensed lender, on their terms.
3.3 We are not your estate agent unless you engage us
Publishing or browsing a listing does not make us your agent. We act as your agent only where you have signed an engagement for a service that expressly says so, and only within its stated scope.
3.4 We are not a law firm
We are not a firm of legal practitioners and we do not provide legal advice. Where our services involve legal work, that work is carried out by qualified Nigerian legal practitioners instructed for the purpose.
3.5 We are not a registered valuer
Estate surveying and valuation in Nigeria is regulated, and formal valuations may only be prepared by practitioners registered with the Estate Surveyors and Valuers Registration Board of Nigeria (ESVARBON).
3.6 We are not a tax adviser
We do not provide tax advice. Information about capital gains tax, including changes taking effect from 1 January 2026 under the Nigeria Tax Act 2025, is general and may not reflect your circumstances.
3.7 We are not a party to your transaction
Where you buy, sell, let or rent through the platform, the contract is between you and the other party. We are not a party to it, we do not guarantee that either side will perform, and we do not act as escrow.
4. Your account
4.1 You must be at least 18 to create an account and must provide accurate information, including a role that genuinely describes you.
4.2 You are responsible for keeping your password confidential and for activity under your account. Tell us immediately if you believe it has been accessed without your authority.
4.3 One person or business, one account. Do not create accounts to evade a suspension, to inflate listing numbers, or to post reviews of yourself or of a competitor.
4.4 Selecting a role such as "Agent" during registration is a statement about yourself, not a verification by us.
5. Listings and user content
5.1 Listings are published by users. We do not verify them by default.
5.2 If you publish a listing you confirm that: the property exists and you are the owner or are authorised to advertise it; the description, price, currency, location, size and photographs are accurate and current.
Accuracy of price and currency
You must state the correct amount in the correct currency, and whether it is a sale price or a periodic rent. A price entered in the wrong unit misleads buyers and damages the platform.
5.3 We may edit, reclassify, suspend or remove any listing at our discretion.
5.4 By posting content you grant us a non-exclusive, royalty-free, worldwide licence to host, display, reproduce and distribute it.
5.5 Reviews must reflect genuine experience. Do not post reviews for payment, of your own business, or of a competitor.
6. The agent directory
6.1 Our agent directory lists people who have registered as agents. Appearing in it is not an endorsement, a recommendation or a warranty.
6.2 Verification badges mean specific and limited things (Unverified, ID verified, Accredited).
6.3 No badge is a statement about the quality or competence of an agent's work.
7. Our paid services
7.1 Where you engage a paid service, these terms apply together with the specific scope, fee and timescale we confirm to you in writing.
7.2 Every service is limited to its stated scope (Verification, Inspection, Legal, Construction monitoring, Short-let, Sale and exit management).
8. Fees and payment
8.1 Listing a property is free unless we say otherwise. Paid services are quoted before you commit.
8.2 Prices published on the site are indicative and may change.
8.5 We do not hold client money
Never send money intended for a property purchase, deposit, rent or contractor payment to us. Our fees are the only payments we accept.
9. Conflicts of interest
9.1 We hold interests that may not align with yours (commissions, referral fees, short-let management).
10. Nigerian property: matters you must understand
10.1 There is no freehold land in Nigeria (Land Use Act 1978). Governor's consent is required to assign land. Registry records may have limits.
11. Prohibited use
11.1 Prohibited activities include fake listings, scraping, impersonation, and fraudulent solicitations.
12. Intellectual property
12.1 The platform, design, software, and branding belong to Apartments Global Limited.
13. Data protection
13.1 We process personal data under the Nigeria Data Protection Act 2023 and our Privacy Policy.
14. Availability of the platform
14.1 We try to keep the platform available but do not guarantee uninterrupted access.
15. Disclaimers
15.1 The platform and its content are provided as they are, without warranties of accuracy regarding third-party listings.
16. Our liability to you
16.2 Subject to clause 16.3, our total liability is limited to the greater of fees paid in the previous 12 months or ₦500,000.
16.3 What we do not limit
Nothing excludes liability for death, personal injury, fraud, or consumer rights under the FCCPA 2018 that cannot be lawfully excluded.
17. Your liability to us
17.1 You will indemnify us against claims arising from your breach of terms or unlawful conduct.
18. Suspension and termination
18.1 You may close your account at any time. We may suspend or close accounts for breaches.
19. Complaints
19.1 Contact us first with issues. You may also escalate to the FCCPC or NDPC.
20. Changes to these terms
20.1 We may change these terms with reasonable notice before they take effect.
21. Governing law and disputes
21.1 Governed by the laws of the Federal Republic of Nigeria, with Lagos State courts having jurisdiction.
22. General
22.1 Entire agreement provisions, severability, and electronic records validity under the Evidence Act 2011.
